Intellectual Property and Data Policy
Who owns input and output, and when data is used for AI training
Rights in your data
Arterect Inc. respects your rights in your own data, and sets out clearly how intellectual property and data are handled when you use our AI services.
Scope
This policy sets out the rights and obligations that apply to entering, producing, storing and using data in the AI services and platforms provided by Arterect Inc. (“we”, “the Company”) (“the Services”).
Ownership of input
Ownership and intellectual property in the prompts, text, images and other data a user enters into the Services (“input data”) remain, as a rule, with the user. We claim no rights in input data beyond what is necessary to provide the Services.
Rights in output
The right to use text, images, code and other content generated by the AI in the Services (“output”) belongs to the user. Whether output attracts copyright is a question for the law of each country, and we make no warranty that it does. Users may use output freely, commercially or otherwise, but not in any way contrary to law.
Use for AI training
Input data and output from users on a paid plan are never used to train or improve AI models. On a free plan, input data and output may be used to train and improve models in anonymised and aggregated form, unless the user has explicitly opted out. Upgrading to a paid plan stops use for training entirely.
Storage and deletion
Input data and output are kept only for as long as providing the service requires. Users may request deletion at any time and we will act on it within a reasonable period, except where the law requires us to retain it.
Third-party rights
Users should take care not to infringe third-party intellectual property when using the Services. Where input data includes third-party works, clearing the necessary rights is the user's responsibility.
Changes
We may revise this policy as the law or our services change. Where a change is significant we will announce it on this website in advance.
